Close to a month now, our airwaves have been consumed by an overflow of hot magma from an Investigative piece carried out by Anas Aremeyaw Anas who has proven himself worthy of trust both locally and Internationally. He's had numerous works done across board from his investigative piece on the malfunctioning state of the Osu Children's Home, corruption at the Customs, Excise and Preventive Service, and the deep rooted corruption in our Judiciary. In all of these works, Anas was faced with intense resistance from people and institutions who felt his methods used in fishing out information were illegal and constituted breaches of individual and institutional privacies. But, his current work on the Ghana Football Association has generated volcanic salvos and Politicians who have long pride themselves as anti-corruption crusaders are strenuously pursuing court injunctions to bare Mr. Anas from showing the detailed contents of the video. The said video is perceived to be explosive and well packed with unquantifiable corrupt practices perpetrated by Public officials, most especially those at the GFA. Certainly, the attempt by some known faces who are doing everything they can to prevent Public viewing of the said video is shocking and raises much concern about the reasons behind the tussle to halt the public viewing.
Openly, extensive concerns about the investigative work have been raised and it bothers on the issues of ENTRAPMENT. A section of the populace, most especially those caught on the tape and those who feel threatened, have advanced an argument that Anas' modus operandi constitutes an act of inducement which is illegal in Criminal Law. For this reason, they feel violated and robbed of their privacy in the process of performing their lawful duties as Public officials . I have disagreements with persons who think the Investigative piece carried out by Anas constitutes ENTRAPMENT and upon these disagreements I have premised my question on. What's the difference between ENTRAPMENT and OPPORTUNITIES? The courts are there to verify, clarify and prove this but I think it's important we maintain our balance and rethink over some of these misplaced thinking and legal distortions.
Methinks, ENTRAPMENT embodies forceful coercion, harassments, intimidations and threats. When one or more of these elements are used to get a person into committing a crime or an act of corruption, that is when I think issues of ENTRAPMENT can be raised . The question we then need to ask ourselves is that " did Anas employ any of the above elements to get his victims into succumbing to his ploys?"
On the other hand, Anas' modus operandi has a semblance of what is referred to as "OPPORTUNITIES" in criminal Law and this is acceptable in trying to catch up with individuals or persons believed to be perpetuating criminal acts. In this case, the right environment and circumstances are created to elicit a suspicious and perceived response from an individual or group of persons who have been fingered and believed to be committing crimes. In our case, it has to do with perceived corrupt Public officers. In the Anas piece, the conditions were same; Mr. Kwesi Nyantakyi and the others were given the opportunity to prove the sanctity of their INTEGRITY that stood as the basis for their election and appointment into public office. Their integrity was put to test but they failed to prove themselves of any such thing as INTEGRITY having compromised the Ethics of the highly dignified office they occupy.
Notably, in the scientific world, real life situations are first duplicated in the Laboratory under a controlled environment with manipulated variables or clinical applications of drugs yet to be tested on humans before they are tried in a natural situation. The validity and efficacy of most scientific thesis are first tested and proven in the Laboratory before they are applied in human situations and mostly, results obtained under controlled environment are same or similar when applied in real life situations. This shares light on the exact work being carried out by Anas and his able investigative team members. There maybe one or two issues concerning the filming or videoing of his works but I strongly disagree with the issue of ENTRAPMENT. Questions may be raised about how appropriate it is for him and his team to have filmed their victims without their knowledge but this also has been taken care of by the Law. To an extent, secret filming of events are permitted when they are in the interest of the State. Why do we not see anything wrong when bad happenings like robbery and raping are filmed by private citizens who later tender in the videos to aid police investigations? Having said this, it doesn't in anyway dismiss the legitimacy of discussing the appropriateness of his secret filming as part of his modus operandi.
Surprisingly, the MP for a Assin Central, Kennedy Agyapong who prides himself as an Apostle of the fight against corruption has been acting weirdly in an attempt to discredit the investigative piece executed by Anas. It's mind boggling to understand why Mr. Agyapong has chosen this path. Where was this Honorable MP when this same Anas exposed the CEPS officers who were extorting monies and allowing smuggling on our Borders? Didn't this honorable has anything to say at the time? Where was he when our Judges were caught on tape accepting goats, yams and auntie Muni "waakye" to bend the wheels of justice? Did this honorable condemn or resisted Anas for premiering the video at the AICC? What kind of selective condemnation and hypocrisy is this ? Could it be the case that Mr. Agyapong is secretly engaged in corrupt practices that may land him in Anas' domain sometime now or later in the future? This Honorable has chosen to go personal and he's been childishly and shamefully making wild allegations against Anas. Honestly, this kind of tantrums and personality attacks doesn't qualify to weaken the expose' and taint the image of Mr. Anas. The rubbish and senselessness being spewed is too much.
Essentially, creating "OPPORTUNITIES" for people to willingly and voluntarily commit a crime doesn't amount to ENTRAPMENT. The African situation and level of corruption calls for this modus operandi and I must admit that Anas has been a blessing to mother Ghana and the world. I pray the Almighty God shield him as he did for Joseph who found himself in a foreign Land. He has found himself on the Land of corruption where his soul loathe to stay and his eyes remains restless as corruption is being perpetrated.May the plagues and curses outlined in Deuteronomy chapter xxviii:15-68 befall all your Adversaries who seek to take your life.
